CITC decree on calculating costs and compensations related to repairs of call drops occurring to communications network pertaining to the STC

The Governor of the Communications and Information Technology Commission, with the powers he holds, and pursuant to what was stated in the Telecommunications Act, its Bylaw and the Ordinance of the Communications and Information Technology Commission, after reviewing what was stated in the recommendations of the Committee composed in the Commission to study the Report submitted by the Saudi Telecommunications Company for reviewing and updating the principles and rules organizing how to calculate compensation for damages that occur to the different types of the communications network installations pertaining to the Saudi Telecommunications Company, what was stated by recommendations not approving calculating the lost revenue, as it does not comply with the judiciary trend in the Kingdom, supposing that long distance communications cable links pertaining to the Company shall have alternative tracks, and in accordance with the work benefit requirements.

(Decides the following)
Article One:
Approval to calculate costs and compensations related to repairs of call drops occurring to communications network pertaining to the Saudi Telecommunications Company in accordance with the text received from the Company attached with this decision with the exception of:
  1. The Company shall not count any lost revenue on call drops.
  2. Administrative expenses added by the Company on costs shall not exceed 15% of the costs of repairing the damage following the example of the current work, and not exceeding S.R.(10000) as maximum. 
Article Two: ​
The Saudi Telecommunications Company shall count the compensations for damages that occur to the different parts of the communications network pertaining to the Company pursuant to the principles referred to them in Article One of this Decision, for the violations that occur after one month from the date of issuance of this Decision.
Article Three: 
The Saudi Telecommunications Company shall be entrusted to review these costs annually in accordance with the latest developments that may occur to the costs of the cables and the civil works and submit them to the Commission a month prior the end of the year for approval.
Article Four: 
This Decision shall be communicated to the Saudi Telecommunications Company and the concerned parties to act accordingly as of the date of its issuance.
